For those who followed terrorism in the '80s (before it was a national obsession), the Seventh Circuit's Hegena v. Islamic Republic Of Iran deals with a judgment enforcement action brought by the family of an American murdered during a 1984 hijacking of a Kuwaiti Airlines jet, undertaken by Hezbollah. After obtaining a judgment against the Iranian government, the Hegenas attempted to execute a writ of attachment against two Chicago condominiums owned by Iran. However, because the plaintiffs had previously accepted a partial payment, pursuant to the Victims of Trafficking and Violence Protection Act, the Court precluded the victim's wife and children from attaching the Chicago condos.
